Supreme Court sets aside Allahabad HC order in Yes Bank-Dish TV dispute, orders fresh adjudication (JAN 24, 2023)

The top court was hearing an appeal filed by the bank against the November 25, 2021 order of the Allahabad High Court refusing to quash the notices under section 102 CrpC and FIR lodged by the police.  Yes Bank said this was one of the most extraordinary cases where “malafide” criminal proceedings were initiated to scuttle the voting rights of the largest shareholder of the Essel Group.

The FIR against Yes Bank was lodged by Essel group founder Subhash Chandra over allegations of fraud in the merger transaction between Videocon D2H and Dish TV India.

DELHI HIGH COURT 

Delhi high court notifies rules for live-streaming proceedings (24 JAN 2023)

The Delhi High court notified the rules for live-streaming of court proceedings and prohibited unauthorised recording, sharing or disseminating live-streamed proceedings or archival data, according to a notification people familiar with the matter said. 

The notification was issued on January 13 and will apply to the high court and all courts and tribunals over which it has supervisory jurisdiction.

COMPETITION COMMISSION OF INDIA (CCI)

CCI: Acting Chairperson’s tenure extended as Centre delays appointment of new Chief (24 JAN 2023)

The Corporate Affairs Ministry (MCA) on Tuesday extended the tenure of Competition Commission of India’s (CCI) Acting Chairperson Sangeeta Verma until the date on which a new Chairperson is appointed or till any further orders.  Verma, who is from the 1981 batch of the Indian Economic Service (IES), joined CCI as a Member on December 24, 2018.

CCI has been without a regular Chairperson for the last ninety days since October 25 last year, when the erstwhile Chairperson of CCI Ashok Kumar Gupta had demitted office after a four-year tenure.

ADVERTISING STANDARDS COUNCIL OF INDIA (ASCI)

ASCI tightens disclaimer guidelines; 80 percent consumers did not notice disclaimer in ads, highlights survey (24 JAN 2023)

The Advertising Standards Council of India (ASCI) has come up with updated “Guidelines for disclaimers made in supporting, limiting or explaining claims made in advertisements”.

Having processed over 800 advertisements which were found to be in violation of the disclaimer guidelines, the new ASCI code requires the advertisers to support their advertisements with suitable disclaimers, which will thereby, help the consumers to properly read and understand the information presented.
