About the conference
Thematic background of conference In the wake of covid -19, technology has become all pervasive in enabling and driving the world affairs, thereby ,making an alternative virtual world order an inevitable reality that we are all to adapt to without any exceptions and excuses. And therefore the interface between technology and law now deserves and demands special attention. So, under the overarching theme of "Technology in the Legal Profession: Challenges and the way forward" we intend to delve into diverse aspects of the interplay between technology and the legal profession and to ensure that a holistic road map is charted out to address the challenges in this regard. Justice systems around the world are moving away from legacy paper- based procedures to embrace digital technologies. This transition to so- called digital justice is redefining the ways in which justice is delivered. Unburdened by the old processes and procedures, the justice system of tomorrow promises to be more efficient, fairer, and less expensive. But the question is are we ready for this technological shift? Covid-19 has impacted Indian judicial system as well and therefore it is imperative to address some of the issues that have arisen as a result of it, namely, how has the Covid-19 pandemic affected the functioning of the courts? What will the post-pandemic court look like? What role does digital literacy play for virtual courts and what does this mean for the most marginalized?
The coronavirus pandemic has exacerbated the urgency to use technology, with the Supreme Court conducting some virtual hearings through video conference and also announcing to set up virtual courtrooms to minimize disruptions. The possibilities of courts standardizing video-conferencing, virtual reality studios, mobile app- based modules and other such technologies as they advance has to be inquired into. Currently, the stage is being set to bring about a radical change, the change that we all have been assessing and contemplating and have yet always resisted and to some extent ignored.
The change we need to make is based on the framework of People, Process and Technology (PPT). For driving organizational efficiencies, it is the people who work with processes and technology to deliver greatest results. It is essential to determine how the PPT framework has to be worked out so as to make this radical transition smooth. The E-courts cannot function without adequate privacy safeguards and data privacy laws which if adopted will have the potential to encourage innovation by enabling a safe and healthy ecosystem. Thus, the specific privacy concerns are to be identified and how those concerns can be allayed is to be deliberated upon. ICT has become integral to judicial administration with the advancement of technology to enhance the productivity and efficiency of the judicial system while making it transparent, accessible and affordable. How the existing schemes like E- court Mission Model project, tailor-made for digitalization of judicial
The advanced technological changes in the legal system will bring a new set of challenges for lawyers and for judges. Thus, it has flung open an array of concerns like impart training to lawyers, judges. Clerks and others to function efficiently and stay relevant. In the new virtual ecosystem and the need of enhancement of digital security across all activities and monitoring them etc. The concept of access to justice will change and it might be become particularly challenging for the weaker section of the society to seek justice in an advanced technology driven system. So, in what way can technology be employed to safeguard and enforce basic judicial rights and ensure inclusiveness is to be focused upon.
